Montgomery County Special Laws and Rules

Special Laws that apply to Montgomery County and cities within.

Montgomery County 

The Montgomery County Department of Housing and Community Affairs Division of Housing and Code Enforcement, Landlord-Tenant Affairs section, handles Montgomery County Landlord-tenant issues. City of Rockville

The Rockville City Code and Charter can be viewed online. The section concerning landlord-tenant law is in Chapter 18, Article IV of the code. You can call or visit the Landlord/Tenant Affairs Commission to get more information or file a complaint. 

City of Gaithersburg

The City of Gaithersburg’s Landlord-Tenant Code can be viewed online. The City’s Neighborhood Services Division can answer landlord-tenant questions and can mediate disputes between landlords and tenants.

City of Takoma Park

The City of Takoma Park's landlord-tenant laws can be found online. The City’s Housing and Community Development publishes a Landlord-Tenant Handbook of Laws and Regulations for Takoma Park (Spanish) that provides information. You can also call or visit them for help.  

Takoma Park allows renters a right of first refusal if the home they are renting is placed on the market for sale. The law is called the Tenant Opportunity to Purchase Act. See the City of Takoma Park’s website for more information and a link to the text of the law.
